You are responsible for complying with all laws, rules, and regulations that apply to your activities and to the tours you offer. This Guide Agreement (“Agreement”), as amended and supplemented from time to time, constitutes a legally binding agreement between:
(a) BOOK@FRIENDS (“we,” “us,” or “our”); and
(b) a natural person or legal entity (“Guide” or “you”) who accesses and uses the BOOK@FRIENDS marketplace platform via the website www.bookatfriends.com and https://bookatfriends.company.site/ and subdomains (the “Website”) to offer sightseeing tours, activities, and other related services (the “Tours”) for sale to users seeking tours (“Travelers”).
You represent and warrant that:
(a) You have read, understood, and agree to comply with and be bound by this Agreement;
(b) You are either a natural person at least 18 years old, or a duly organized and validly existing company, organization, or other legal entity in good standing under the laws of your jurisdiction;
(c) You are legally capable of entering into binding contracts; and
(d) BOOK@FRIENDS does not prohibit you from accessing and/or using the Website.
If you do not agree to be bound by this Agreement, you may not apply as a Guide or publish, offer, or sell any Tours on the Website.
This Agreement must be read together with our Terms and Conditions, Cancellation Policy, and Privacy Policy, which are incorporated herein by reference.
We operate the Website as an online marketplace that connects Travelers and Guides. The Website allows you to publish and offer Tours on the Website and on third-party websites through which BOOK@FRIENDS makes Tours available, and to communicate directly with Travelers to conclude contracts.
We publish your Tours. Reservations are made by Travelers directly through the portal. We are not a travel agency and do not provide Tours ourselves. You are solely responsible for your published Tours.
When you accept a reservation from a Traveler, you enter into a direct contract with that Traveler. Under no circumstances is BOOK@FRIENDS a party to any agreement between you and a Traveler.
We promote the Website and Tours via search engine optimization, pay-per-click services, public relations, email marketing, affiliate programs, and other online and offline promotional methods.
We continuously update and improve the Website and may modify, remove, or introduce features from time to time.
You understand and agree that you are not an employee, independent contractor, agent, joint venturer, or partner of BOOK@FRIENDS. You act exclusively in your own name and for your own benefit.
BOOK@FRIENDS does not direct or control your performance under this Agreement.
You acknowledge that:
(a) You may engage in other businesses and activities at your discretion;
(b) You operate your own independent business, separate from BOOK@FRIENDS;
(c) You have full discretion over publishing, selling, and conducting your Tours, including accepting or declining reservation requests;
(d) You set your own Tour prices;
(e) You report to no person at BOOK@FRIENDS.
You have no authority to make representations on behalf of BOOK@FRIENDS.
To publish Tours, you must register online.
By registering, you agree that we may conduct background checks, verify information, and request reports from third-party providers or public records, including criminal records or driving records where permitted.
Registration is at the sole discretion of BOOK@FRIENDS. We may refuse publication or terminate a Guide account for any reason.
You must provide accurate and complete information. Personal data will be handled in accordance with our Privacy Policy.
You are solely responsible for all information you provide.
You grant BOOK@FRIENDS a non-exclusive, worldwide, royalty-free, irrevocable, perpetual, sublicensable, and transferable license to use, reproduce, display, distribute, modify, and promote your content for marketing purposes.
You warrant that you own or control all rights to such content and that it does not infringe third-party rights.
You agree to indemnify BOOK@FRIENDS for any third-party claims arising from your content.
Content includes profile information, images, Tour descriptions, pricing, and related materials.
You may not upload content that is fraudulent, defamatory, obscene, discriminatory, illegal, contains contact details before booking confirmation, or includes watermarks.
We reserve the right to remove infringing content without notice.
Travelers may search without registration. You will be notified via automatic email when a reservation request is made.
Travelers may pay by credit card or other Website-supported methods. You appoint BOOK@FRIENDS as your limited payment collection agent solely for processing reservation fees.
BOOK@FRIENDS does not charge Guides any commission.
100% of the Tour price is payable directly by the Traveler to the Guide onsite.
You agree to comply with the Cancellation Policy in effect at the time of booking.
BOOK@FRIENDS may cancel reservations if necessary to prevent harm.
You agree to issue refunds (full or partial) in cases including:

Arbitration:
Informal negotiation is required for 45 days before arbitration.
You may opt out within 30 days.
All disputes must be conducted on an individual basis. No class actions permitted.
Neither party is liable for failure due to force majeure.
BOOK@FRIENDS may modify this Agreement with 30 days notice for material changes.
Effective upon submission of application.
