1. Business Purpose and Role of BOOK@FRIENDS
1.1 BOOK@FRIENDS FZ-LLC, Ras Al Khaimah, United Arab Emirates (“BOOK@FRIENDS”), operates a platform for the intermediation and administrative coordination of individually provided tourism services.
1.2 BOOK@FRIENDS is not a tour operator.
1.3 BOOK@FRIENDS does not organize, operate, or conduct tours itself.
1.4 All tours are conducted exclusively by independent, self-employed local tour guides or service providers (“Tour Guide”).
1.5 Tour Guides are neither employees nor agents of BOOK@FRIENDS.
2.1 By making a booking, two separate and legally independent contractual relationships arise:
a) Intermediation Agreement
between the customer and BOOK@FRIENDS
regarding the reservation and coordination service.
b) Service Agreement
between the customer and the selected independent Tour Guide
regarding the operational execution of the tour.
2.2 BOOK@FRIENDS is not a contractual party to the service agreement.
2.3 The validity, performance, non-performance, or termination of the service agreement does not affect the already completed intermediation service.
The intermediation service includes in particular:
The intermediation service is of an administrative and digital nature.
4.1 The intermediation service is deemed fully performed once:

4.3 The intermediation service is independent of the subsequent performance or non-performance of the tour.
5.1 Online payments made through BOOK@FRIENDS relate exclusively to the intermediation and coordination service as described in section 3.
5.2 Any payment made via BOOK@FRIENDS does not constitute a prepayment of the tour price.
5.3 The tour price for the execution of the tour is to be paid separately and directly to the Tour Guide on site, unless otherwise agreed with the Tour Guide.
5.4 BOOK@FRIENDS does not collect payments for the operational execution of the tour.
6.1 The Tour Guide is solely responsible for:

6.3 BOOK@FRIENDS assumes no liability for the operational execution of the tour.
7.1 A cancellation by the customer affects exclusively the contractual relationship with the Tour Guide.

7.3 BOOK@FRIENDS may, at its sole discretion, convert the intermediation fee into an unlimited credit for future reservations.
For certain services, in particular city tours, desert safaris, as well as boat or yacht tours, the respective Tour Guide may require full prepayment of the tour price.
If such prepayment has been made and the customer cancels the tour although the service can objectively be performed by the Tour Guide at the agreed date, there is generally no entitlement to a refund of the paid tour price.
By making the booking and payment, binding organizational, personnel, and operational arrangements are initiated. These include in particular:
The Tour Guide makes the booked service fully available at the agreed date. If the customer decides not to make use of the service for personal reasons, the agreed tour price remains payable.
A refund shall only be granted if the execution of the tour becomes impossible due to reasons within the responsibility of the respective Tour Guide.
Mandatory statutory consumer protection rights remain unaffected.
The contractual service shall be deemed properly provided once the respective Tour Guide makes the booked tour available at the agreed time and holds the required capacity for its execution.
If the customer does not make use of the service for reasons within their own decision or organization, this shall not be considered a failure to provide the service.
In such case, the agreed tour price remains payable.
8.1 BOOK@FRIENDS shall not be liable for delays or non-performance of the intermediation service if caused by circumstances beyond its reasonable control, including in particular:
8.2 Force majeure events affecting the execution of the tour fall exclusively within the responsibility of the Tour Guide under the separate service agreement.
8.3 Once the reservation confirmation has been transmitted, the completed intermediation service remains unaffected by such events.
9.1 BOOK@FRIENDS shall only be liable for intentional misconduct or gross negligence in connection with the intermediation service.
9.2 Any liability for acts, omissions, delays, changes, or cancellations by independent Tour Guides is excluded.
9.3 BOOK@FRIENDS shall not be liable for the impossibility of performing the tour due to actions of third parties or governmental authorities.
10.1 The customer agrees to contact BOOK@FRIENDS first before initiating any chargeback or payment reversal.
10.2 The customer acknowledges that the online payment relates exclusively to administrative intermediation services that have already been provided.
The customer agrees that payments made through BOOK@FRIENDS relate exclusively to the already performed intermediation and reservation coordination services.
By completing the payment, the customer confirms that these services are provided immediately after booking and transmission of the reservation confirmation.
The initiation of a chargeback for services that have already been performed or made available under these Terms may be considered a breach of contract.
BOOK@FRIENDS reserves the right to submit booking confirmations, reservation records, and communication logs as evidence in payment dispute procedures.
These Terms shall be governed by the laws of the United Arab Emirates.
